Occupational certificate

Hi
We have got our building redeveloped & the possession was given last year. however the occupational certificate was not issued by the builder saying that the certificate would come in in 3 months time & he had applied for it
Only last month the officer from the municipality came in to see the building. he did not have a look at the entire building & said that the 12th floor of the building was illegal & that it would cost is 1 cr to get the certificate & we wold also need to pay him 20 lakhs over & above that.
i wanted to know if there is a way we can find out if the building's 12th floor was illegal as we have always seen the plan with the 12th floor.
the builder is not available for any sort of help & has vanished & is unreachable
also is there a way for us to directly apply for the oc & pay whatever the penalty is..... or can we take some action on the builder & have him to pay for this OC
please advice as this amount is very huge for middle class people like us who live in the building
this building has been built in Mumbai Andheri west

You have redeveloped the building and are capable enough to incur the legal expenses by entrusting the matter to a prominent advocate in Mumbai instead of seeking free legal advice here as our advice is only a guiding factor many times and could not solve the problem practically as the query is online and many papers are to be scrutinized to settle the matter.

WE HAVE HIRED A LAWYER WHO HAS OBVIOUSLY NOT DONE A GOOD JOB & HENCE I HAD LOGGED IN HERE TO GET AN OPINION OR OPTION ON WHAT NEEDS TO BE DONE
HOWEVER I AM EDUCATED & KNOW THAT WHEN A BUILDING IS RECONSTRUCTED ITS NOT BY OUR MONEY BUT BY THE BUILDERS THAT DOES NOT MAKE US RICH OR GIVE YOU THE AUTHORITY SAY WHAT WE CAN AFFORD VS WHAT WE CANT.
