Can an advocate can file suit on behalf of petitioner in the court, who has gone to respondant's home with petitioner and petitioner's relative, on request by petitioner without prior intimation and threatened respodant. Respondant has N.C. in the police station against petitioner and along with advocate very next day. After 8 months petitioner has filed suit appointing the same advocate against whom N.C. was filed. Can respondant has any remedy for this? Can respondant apply to the court and bring the fact before the court and remove the same advocate from appearing on behalf of petitioner? Can answer differ if it is criminal or matrimonial matter?

No it cannot be done. It is not a valid ground to make any such objection at all. After all he is the counsel for the petitioner and not for you.
