FIR

Querist : Anonymous (Querist) 23 September 2010 This query is : Resolved
If FIR submitted in magistrate Court without signature of Police Station officer or IO or any other officer and also no signature on the statement of the complainant, what effect it gives? Who is responsible for that? Even suspect is also released by submitting request report under CRPC 169 by IO.

Request to suggest

S.H.O. AND I.O. COULD BE PROSECUTED BY THE COURT U/S 340 Cr.P.C.

The signature of the Police officer is not necessary if the case is submitted before a magistrate but in all cases, signature of the complainant is a must.
Hope u find ur answer

Thanks for reply,

My signature is there but not below my statement which I given in Police Station and which is reflected in FIR. Signature of the next page of suspect.

I agree with Expert parthaprotim borbora.
Mr. Anonymous, In the first place you said there is no signature in your statement and now you say something else. You come out with the correct facts instead of going in a round about way. I don't this LCI is some class where students are given bit by bit problems to solve. It is better for you, not to, either conceal or hide facts, if you need proper reply. Otherwise the experts will be forced to commit errors and that will not be in the best interests of this forum. So be plain and come out with all the correct facts in the beginning itself whenever you raise your query.

Respected Ragnathan Sir,

Sorry for inconvinience.

I just want to say that the FIR copy which I recd. on the next day of filling of FIR from police station and the attested copy which I recd from Court having differences of Signatures.

Copy which I recd from police station having 2 Signatures of mine and 2 signatures of IO . one signature of mine under the statement which I given like when, where & how the crime was happened as "statement given by" and 2nd signature as "Complaintant "and IO's 1st Signature under "Statement taken by" and 2nd signature under "Police Station Incharge"

Attested Copy which I recd from court having no signatures of IO and only one signatures of mine under "Complaintant ".
2 signatures of IO and one of Mine is Absence.

Its necessery that the copy which I recd from police station and the copy which is submitted by IO in the court must be same?

Request to suggest.

yes it is necessary

absence of your signatures on the complaint would definetely give a strong point to the defence at trial and u may loose your case.
