Withdrawal from PF

(Querist) 26 October 2010 This query is : Resolved 
One employee has been terminated from his services. he submitted Form 31 for partial withdrawal from his account, which is supposed to be for final withdrawal. and the reason cited is "illegal termination". can ex employee mention such reason for withdrawal of advance. is he right to submit form 31. can the company refuse to sign wrong form.

Yes. Company can refuse. It is signed it would amount to an admission that the termination is illegal.

The department is not concerned with the fact whether the termination is legal or illegal. For making payment the information regarding termination is necessary for the department. In case, the employee has written illegal termination. you may correct tthe fact by giving real position. But an employer can not refuse.
