I would like to know Fixation of Pay for Short Commissioned Officer
I Bindu M.G., Ex-Lieut, short service commissioned officer, had raised my application of “Fixation of pay” after successful completion of 2 year probation period in central government organization.
Being a short service commissioned officer and serving the country for 5 years, till date(more than 6 years I am working with central governemtn organisation) I am not in receipt of “Fixation of Pay” privilege.
I would like know to should I need to PAY BACK the Gratutity Amount received from Military service for fixation of pay ?
How this Fixation of Pay is calculated ?
Where should I apporach for fixation of pay as my current employer is not ready to process this ?
As I am earning contributing pension, I am not interested in counting my service for pension purpose. I just need to fixation of pay then also I need to pay back grautity amount ?

Current employer is bound to fix your pay subject to your deposit of gratuity received from military service. You can serve a legal notice from your counsel in this regard if this legal right is not being provided to you.

At present organisation is providing contributing pension and I am not interested in counting my service(service count) for pension purpose.
I need to get pay fixation benefit only then i need to pay back grautity amount ?
If i need to pay back gratutity should i need to pay interest for the amount ? Because orgnization is Delaying the processing

Sir,
I am released short service commissioned officer completed 5 year service from indian army (from September 1996 to sep 2001) with 3 year pre-commission training sep 1994 - sep 1996.
I have joined the civil service in dec 2005. As per Order 8 of CCS(Fixation of Pay of Re-Employed Pensioners) Orders 1986, I am eligible for pay fixation and would like to know while fixing the pay should my pre-commission training will be included i.e. 5 + 3 ? or only service period
Also as I have joined civil service in dec 2005 and governed by new pension scheme. As per rule 19(1) of CCS(Pension) Rules if I refund the terminial grautity received from past service shall I elgible for counting the past military service and pension covered under old pension scheme ?
Kindly guide nd help me also refer to applicable rules related to this so that I can communicate my case in my department for fixation of pay and counting service for civil pension.
