Non execution of the Terms of Sale Deed and Undertaking givne before Police

(Querist) 06 April 2011 This query is : Resolved 
Seller showed me an Agricultural plot and its Title Deed(7/12). In good faith the Sale Deed was made and due payments made. The seller was asked to proved that the shown plot actually pertains to the Title Deed given. Private Land Survey was made and it was found that the Plot belonged to adjacent farmer and mine in that farmer's compound along with his own land. The farmer says I had not put a fence to my plot and that he has been enjoying that plot for over 12 years and cannot give me. Police complaint was lodged and the seller gave an undertaking on stamp Paper that he would give that land along with approach road to nearby public road. He has not given peaceful possession of the said plot for over last 2 years and not fulfilled the commitments as per the Undertaking given at Police Station, to me, against my complaint. Under what all charges he can be sued in a Civil/Criminal Court after sending him a legal notice
