Querist : Anonymous (Querist) 30 April 2011 This query is : Resolved

In the entrance of the town municipal authoririty charging a sum of tax to entering in to the town. But the administration charging the same amount to the local people's vehicles either own vehicles or taxies. Is there any chance to stay the municipal authority to charging the amount to the local people through any suit or writ petition. If it is yes please send me some cytations and caselaws. thanking you

I think you can submit an RTI application and collect information .Then you can move for Writ.

First check whether the Municipality is authorised by any Law or Ordnance to collect such tax.
f yes then the legality of the said provisions will have to be checked after which the same can be challenged before the High Court under Writ jurisdiction of the high court.
