dear sir, my marriage is christian marriage, iam a sc caste and my wife is a bc-christian. wife is a govt employee. is it possible to file maintanance case against wife? how much percentage will give the court? in this case wife is a govt employee and husband is an unemployee. if possible please tell the act and process sir. marriage happend in 2006, after 1 month separated not legally.

You can file a petition seeking maintenance against your wife in the given facts. Amount depends upon various factors like liabilities of your wife, you own income, if any etc. Such cases are rarest among rares but are not barred.

Here to also there is nothing to dis agree with Mr. Makkad.Either of spouse unable to maintain him/her/self has right to maintenance against
the other earning partner.

yes you can.. caste or religion is no bar.. but usually husbands wont go for maintenance from wife.. even if its hard to manage his day to day needs mean court will allow it.. but her employment alone not a ground for your case..

dear sirs,
idiscussed with my lawyer, he is telling sec 125 cr pc is order for maintanence of wives, children, parents only, it is not for husbands and in christian marriage no right to ask maintenance from wife to husband. so that my lawyer is filing only divorce petition
