A family settlement can be got executed wherein all other legal heirs of deceased may relinquish their rights in favour of sole son of deceased as desired. No stamp duty is required in such cases.

can property be transfered in widow name without family settlement
ajay sethi (Expert) 22 January 2012
at first you say property is to be transferred in name of sononly as other legal heirs have no objection .
twist in story now that property is to be transferred in name of widow?

ask other legal heirs to execute deed of relinquishment .
V R SHROFF (Expert) 22 January 2012
Pawan,
Mr Raj rightly advised you.
Execute Family Settlement in favour of son .

however, I will advise you (1)to part with it at this stage, as All of you may have to undergo similar procedure (2)it also endanger the possibility, that all of you loose property!! or my any mis -representation or fraud, he transfer to any third party, without ur knowledge.

Son's wife object widow living with her, and the widow thrown on street, starving with her daughter & son . !!

In answer to first post as well as to 2nd post only relinquishment deed is the option by all heirs in favor of desired one.
Raj Kumar Makkad (Expert) 23 January 2012
Even if the property is to be transferred in the name of widow, the relinquishment deed is also required for that purpose.
