Hi Sir,
I have a small commercial shop in my wife's name in Chandni Chowks Dariba kalan in Delhi.This is shop is given on rent to a property dealer on 1.1.10 for 2 years registered rent agreement through court and fee is paid by me. And i did not taken any security amount as well and he against the security he spend some Rs-15000/-in the shop according to his requirement.
In the mean time i told him in Dec 11 to vacate the shop but he now said that give me Rs 50000/- to vacate the shop as i spent it in the shop. otherwise i will not give the rent till this amount adjusted in the rent.
I want to know that what is the benefit of registered agreement through court and what is the right of me to vacate the shop legally but swiftly. Please suggest me what should i do to vacate my shop ASAP. Can i take local police help to vacate the shop or i need court orders to do so as i have registered rent agreement. How a court will help me out to get back my shop in my possession.
Please help me out ASAP.

you vacating from as per legally, so you file RCOP case against him.

You would need to file a case for vacating the said shop.

you have committed following mistakes
1) did not get agreement drafted by lawyer
2) did not take security deposit
3)although period of 2 years have laspsed he is not vacating as there must not be any penalty mentioned in agreement for dfailure to vacate premises on time
4)contact a local lawyer now . issue legal notice
