Tuitions etc. are conducted in society office premises....

(Querist) 19 May 2012 This query is : Resolved
Lots of unlawful activities are going on in our society, as I have mentioned before..
Our society is a mess...
Now off lately secretary has given a permission to one member to conduct tuitions in our society office premises..
As I have said before there are only 6 members staying in our society..out of which 3 are secretary, treasurer & chairman who have formed a syndicate & formed a majority to follow all such abnormal & unlawful practices...Now what should we do to stop all these..? whom to approach..?
Everyday such new nonsense is coming up in our society...what shall we do..?

Dear Himansu,

In your views, how providing tuition in individual capacity by some of the society members is illegal and under the provisions of which act?

If you notice any illegal activity on the part of society, better raise formal objection with proof during general body meeting.

File written complaint to the society

regarding its illegal activities and ask it to stop them.

I do agree that imparting tuition is not an illegal activity but use of society office for that purpose is illegal.

You have got every right to raise your objection against the same and other illegal activities to the registrar of the societies.

Mr. Dhingraji & Siddiqiji I understand your point of view but tuitions are conducted in society premises i.e. society office & not in one's own flat....
As far as I understand commercial activity in society office or premises cant be allowed by secretary to any member...

JANAK RAJ VATSA (Expert) 21 May 2012
conduct of tuitions in the office premises of the society tantamounts to misuse of official position by the office bearers since tuitions are a commercial activity and not permissible in official premises. u may complain and raise the point in MC meeting and if the practice is not stopped, complain to the RCS.
