Your Honours,
In the matter of u/s 134 of NI act,Summon was served by Metro politian Magistrate from Delhi but in conformity of his age about 59years old and incapablity of journey from calcutta to Delhi as his phisical condition is not so good and under doctor treatment.
Please suggest me what the remedy.

Jurisdiction is more important factor.
He is not Sr. Citizen, so age factor cannot be considered.
if cause of action aroused at Delhi, Calcutta cannot be a trial court.
However, his exemption of Personal Appearance [presence]can be Granted u/s 205 Cr. p c
AND IT SOLVE YOUR PROBLEM completely with help of Medical Documents, Age Proof, residence & treatement at Calcutta, Physically Handicapped cert from Civil Hospital & Affidavits. Apply for it.
