We have 10 Bigah property in Fatehabad Tehsil UP, which local villagers have transfer the same on their own name without any court or any other order now we want to get it transfer on our own name.
Please advise what needs to be done.

Dear Sir,
This is seperate matter This property belong to my paternal Grandfather for which we come to know recently from our relative thereafter we get the nakal from collectrate for the same which i shared with you and get to that our property has been transfer to local villagers without any order by court or tehsil.

You have not disclosed how the villagers have got entered their name in record of rights.
It may happen in several ways.If they got it mutated by preparation of any forged impersonated sale deed then your remedy is to file a suit of cancellation of such a deed with in 3 years from the date of knowledge of the deed.If limitation is over or their name is recorded due to false entry in record of rights(called khatauni)then DECLARATORY suit can be filed directly under section 229 of UPZA in the revenue court of SDM OF THE TEHSIL.

you will have to move court to set aside the said mutation . if you cant afford legal fees contact distrcit legal aid centre to fight your case

In the given case, you shall have to file a criminal case against all erring persons includiing Tehsildar, Numberdar and witnesses and shall have to fiel a civil suit seeking cancellation of all proceeding against which you have obtained the nakal from collectorate.
If your position is not to engage a lawyer then move a simple application supported with your affidavit to this effect to the local court which shall provide you legal help from Legal Aid which includes the fees of lawyer, all litigation expenses.
