Cancellation of poa

A person forged signature of a title owner and registered fake PoA and sold it to 8 persons at Chennai, Tamil Nadu. We have complained about it to the city commissioner and they filed FIR and arrested the accused. remanded him and came out on bail. The buyers are Advocates and their family members practicing in Madras High Court. Even there are evidences to cancel the power DRO asking to seek justice from court. PoA-2010, Sales - 2011, FIR-2011, till date it was not cancelled.

Here as advice i can simply say that you should register a declaration to your identity as well as to the fact that the 'POA' dated so and so registered in book no so and on page number so of the sub registrar is an IMPERSONATED VOID FORGED AND FAKE DOCUMENT?Because ,in my opinion, a suit to declare any document void becomes necessity only when the document or deed is VOIDABLE,and NO suit is required for a VOID
AB INITIO DOCUMENT.

In addition you may also and should publish
the fact in News paper.

Complasint to BAR COUNCIL against forgery by Advocates and Notary.

This being so serious a crime, if allowed, many will loose their valuable property.
In Mah State. POA for Property sell compulsorily registered.

We have engaged a criminal lawyer to serve notices, now realize the engaged lawyer even though having in good records, not doing anything. The Sub-Registrar registered the fake PoA is under suspension and at the IG of Registration office say there is a court case pending in Tamil Nadu. Is it true?

Dear Arvind,

You should first realise that it is not "Papad" when you put in hot oil it will get fried and available to you for eating instantly. Therefore, as far as court cases are concerned, refrain from using the word "now realize the engaged lawyer even though having in good records, not doing anything."

Apart from the criminal case, you need to file a civil case also for cancellation of the Sale Deeds. It is not clear from your post, whether the possession of the property has passed on to the buyers. In any case, consult a civil lawyer and take immediate steps to get the sale deeds cancelled.

The question of making any complaint to the Bar Council against the lawyers who purchased the property does not arise, unless you are certain that they have connived in forging the document etc.

File a civil suit seeking setting aside the alleged sale and restoration of the possession, if the same has passed on the buyers.
