How much time

Sir , For last 7 months I have given the application for HMA 13 but till now notice in not issued to my wife so she is not appearing in the court. In last meeting she told me that she will contest the HMA 13. Kindly clarify me how much time it will take to get the divorce decree ? I have two children one is with me and 2nd is with her ?

only after issue of summons will she appear . if your wife is contesting divorce it may take years to get divorce

depends upon pend ency of cases in family court in your city . may take 5 years

as mentioned it depends upon pendency of cases in family court in your city . can take 10 years if more cases are pending

Thanks . It is general thaught that to men court is not giving the Divorce decree easily on the basis of cruelity As it is vety difficult to proove the nature of a lady in court and finaly court is dismissing the petition by men . Is it true ?

Divorce on cruelty ground can also be provided to husband against his wife if he successfully proves the grounds.

It seems that she is not receiving the notice intentionally. If your Advocate should attend the court regularly and insist the Judge to order for substituted service (Notice through paper publication) and push up the proceedings fast, you may get divorce decree in two to three years only. Alternatively, you may also get an order by the court of personal notice on her.

You can get divorce on the basis of cruelty, if you prove the same properly. Hire a good lawyer.

We are no God to say when the case would be finished.
It may take one year or even 20 years.
