New d.c. rules

(Querist) 04 June 2013 This query is : Resolved
Dear Expirts

My premises have undergone for redevelopment.
As per the agreement the builder has promised the existing carpet area 340.00 sq.ft and 34.00 Sq.ft.extra @10%. But as per the plan my existing carpet area is shown as 287.00 Sq.ft. and fungible FSI is shown as 53.00 sq.ft. Please advice
Can a re-developer can interchange the existing area of a tenant and the fungible FSI and tally with the total area promised to be given as per the agreement with re- developer under the New D.C. Rules Mumbai.
Thanks & Regards

As per agreement the carpet area was promised 374 Sq. Ft. while the plan is showing less. Send notice to the developer for this being violation of the agreement. Take the assistance of some professional.

First of all get entire information from architect and then only agitate in the way you have been suggested by expert.
