Solicitor exam

(Querist) 10 June 2013 This query is : Resolved
Why is it that only students who do articleship are allowed to give this exam ? isnt this rather old fashioned ...Nowadays there are very good law colleges such as National Law Universities ( which are touted as IITs of law) which are established which take the students through the grind and are very tough to pass...why NLU graduates are not allowed to appear for the Solicitorship exam ?? This is rather unfair to the students and also a loss for the legal profession...

Dear Rajiv
After the so-called superiority of 5 year integrated Law course, one does not expect such a rudimentary query from you.

You should understand that there is no compulsion for anybody to become a solicitor. But somebody wants to become a solicitor, then one has to abide by the terms and conditions of the Bombay Incorporated Law Society which conducts the examination.

Therefore, your argument that it is unfair to the students or that it entails any loss for legal profession would not cut any ice.

The need and terms of employer for providing employment to applicants are relevant, not of the employment seekers. If you are in need of services of some junior and tend to employ someone, would you like a candidate to dictate terms to you?

A) the query here is why a select few should sport the tag of 'Solicitor' ? While bright candidates who pass the NLU aftera gruellng five year course are denied the opportunity ..

B) i have nothing against the law firms employing few articles - who get a good grounding while on the job and get an opportunity to be a Solicitor by virtue of their practical experience ..my point only is why NLU graduates who go though a gruelling five year course with lots of internships thrown in their overall five year schedule are denied this opportunity ?

C) isnt it time to change the statutes pertaining to Minimum requirements for taking the Solicitorship examination ?

I hope, as a Director of some organisation, you would appreciate that there is a lot of difference between preactical experience while on the job and theoretical lessons learned during academic course. Needless to mention, during academic learning the sole aim is just to pass an exam, while during practical experience actual implications of law are learnt to gain tactics of application of law in varied environments and circumstances.

solicitor system is abolished but exams are still conducted by Bombay law incorporated society . if you want to appear for solicitor exams do articles with solicitor firm for 2 years then appear for exams .
to practise as a lawyer you don't need to pass solicitor exams . those students who have done 5 years NLU course can start practising as lawyer . u don't need solicitor tag

I do endorse the advice of Ajay.
