Good afternoon learned members
My client is staying at Bombay, who is a girl and her parents against whom the compliant is filed before the hon'ble delhi magistrate court U/S 200 Crpc. The court had accepted the compliant and given the PCR number, instructing the police to investigate the case U/S 420 IPC. the police from Delhi magistrate court had gone to Bombay for investigation, but was not able to trace the girl or her parents.
Now my client wants to apply for anticipatory bail U/S 438 crpc.
1)can i apply for anticipatory bail U/S 438 CRPC.
2) Is thr any surety or security to be submitted before the court
3) since the magistrate court had given the order. can i apply anticipatory bail before the session court.
