This query is : Resolved
I am employed with a private bank in Gurgaon(State: haryanaand HO is in mumbai), and working since almost last 2 years and now i want to leave the organization due to some personal reasons.
My company notice period policy is "after confirmation either party will be required to give 3 months notice or salary in lieu of notice at the bank's discretion"
I have resigned from my current position on 29th october 2013 with the notice period of 1 month and in my resignation mail i have mentioned that i am ready to pay 2 months salary in lieu of notice period, i have marked this mail to my manager in keeping CC to my HR person.
Now my manager has marked my resignation in the system and he has put my tentative last day with a calculation of 3 months, and also verbally they are forcing me to serve at least 2 months(not agreeing to 1 month), however till date i have not get any reply from their side on my mail.
Please advise me, if on the last working day as per 1 month notice period i will mark the mail to my super bosses and HR heads also and informed them that today is my last day and with that leave the organization, will i get the releiving letter from bank or not ???

If you don't get reply till the end of one month of your notice, do mail the concerned officials of your company and deposit the salary equivalent to 2 months as per agreement and demand to issue relieving and NOC with experience certificate with full and final settlement of accounts at the earliest.

Apart from the above steps deposit the equivalent amount for the balance notice period as advised by Shri Rajkumarji Makkad.

Along with the above, as rightly advised by Mr.Rajkumarji Makkad, you deposit the salary for the remaining notice period.

With the mail handover physical copy of the same and previous letter on acknowledgement to your boss.
If you and your boss agree you may continue for another month and deposit cheque of your salary dated last day of your working to your Bank on acknowledgement.

Dear Experts,
Thanks for your valuable suggestions.
Please help me on more time on the same case.
Case update: I have not received any mail, neither from HR person nor my boss, on my resignation mail.My boss is saying verbally to me that the company will hold your relieving letter if u'll not serve 2 months notice period and we'll issue you only NOC for no dues once you'll clear all of your dues.
Question: 1.Can the company hold my relieving?
2.What is the meaning and relevance of the "at the bank's discretion" under the offer letter's termination clause?
"after confirmation either party will be required to give 3 months notice or salary in lieu of notice at the bank's discretion"

What is the urgency for you? If you got a new job; seek time with them and serve for the remaining period and get relieved.

Sir here i was working for 11 hours on a daily basis..which is really a problem to manage the personal life also..and i am not enjoying this job.
I got one option with MNC company wherein there is a 5 day working with a proper working environment but they are not giving me more than 1 month(It could be a very good opp. to me). Here i can balance my personal life also, as i am the only son of my parent so i need to take care all the things at my home also.
Please advise.

You have to first know from the MNC whether they will accept you without any relieving letter from your previous employer (i.e. the bank in which you are working now).
Whether they will conduct background check later on and if they find that you have left your earlier employer without proper relieving letter how will they treat you - whether they will understand your position and continue in the job or will terminate you because of your background?
You have to first get this checked very clearly before doing anything.
Further more, it is not clear how do you say that you are working 11 hours on a daily basis that too in a Bank. Unbelievable.
