A BANK OFFICER DEVELOPS RELATIONSHIP WITH THE WIFE OF A & LIVES IN ADULTERY FOR LONG TIME AND ONE DAY "THAT BANK OFFICER WITH THE WIFE OF A" OPERATES A's BANK LOCKER IN THE SAME BRANCH OF BANK WHERE THAT OFFICER IS POSTED AND REMOVES ALL DOCUMENTS & VALUABLES AND DOES NOT MAKE AN ENTRY IN "LOCKER OPERATION REGISTER" WITH INTENTION TO HIDE SUCH UNAUTHORIZED LOCKER OPERATION.
WHAT IS THE LEGAL IMPLICATION OF THE ABOVE ACT OF THAT BANK OFFICER AND UNDER WHICH LAW & SECTION HE IS PUNISHABLE.
PLEASE EXPLAIN........

It is misconduct as well for which disciplinary proceeding may be initiated against him.

If it is proved that the Bank Officer has done so, disciplinary and criminal cases need to be filed.
Practically it would be very difficult to prove that any article was removed from the locker as the Bankers are never aware with the contents of the locker. If the locker was in joint name of the lady and her husband (operation E or S) she has authority to operate the locker but after proper entry in the register. If it was in single name of the husband, how the key passed to wife.
FIR under various sections can be lodged and let the police try to recover the documents and articles and also gather other proofs.

When the Locker is in your wife's name she could very well operate it.Even if it is in Joint Name with some body like what you say the Bank Officer also they could operate.If it is going to be in your name Or you have the Locker jointly with your wife and if things were removed with out Record of Opening then you could file a Criminal Complaint on your Wife and the Bank Officer as well.Even for adultery you could sue both of them as a seperate case.Consult a Lawyer
