Will

(Querist) 30 December 2013 This query is : Resolved 
Hi,

A will was made by father in the year 2013 and divided it amongst his 2 sons and one daughter now he want to revoke it.

But the property which he divided through is will is on the name of his wife and wife is no more.

Now the father want to sale that property but as he created a will her daughter is not giving a NOC to sale it.

So what is the option.

Does after the expiration of wife property automatically goes to kids ? or husband is entitle after the death of wife.

It is not a ancestor property it is made by the husband itself only.

will can be revoked at any time . but father has to be owner of property to bequeath property by will . if property standing in name of wife on her death her legal heirs would have equal share in property

Father can not bequeath the property of mother. If mother expired intestate her property would go to her legal heirs.
