Old property (pushtani jameen) on sale

(Querist) 23 January 2014 This query is : Resolved
Dear Friends,

I need a help on the property.
We have a 40 year old property (2800 sq ft) in Khargone, District, MP, in the name of my grand father, and he has three brothers (my father, uncle and my father's elder brother). currently the registry is in grand father's name. And, 1996 and 2000 my father and his elder brother deceased. Now, we have only one brother left my uncle (chachaji).
But, in 1999, becz of my family condition, both the brothers has signed a document saying we are agreed to give this property to my mother and signed on a paper (not stamp).

And, now every body is asking for their part in the property.

My question is: the document they signed in the 1999 on a local paper (just on the content), would that be legal doc on getting the full property rights? we also have a property nomination document from the registrar office saying now this property is nominated to my mother.

Sorry its too long to write, still some info not added.
Please ask the question if you have any to help me out.
Thanks

both brothers have to sign deed of relinquishment duly stamped and registered to give up their share in property . mere signature on plain paper wont suffice

but what about nomination document from registrar office which says this property is nominated to my mother... would it be legal...and can we sell the property based on this...we have the original registry paper.

Nominee doesn't work. There must be regd., document like will or rights relinquish deed in your mother's name
Rajendra K Goyal (Expert) 23 January 2014
Unregistered document, merely written on plain paper has no validity till turned into registered document.

Nomination has any vale is doubtful in this case.

Contact a local lawyer and show him all the documents.

I do agree with the advice of Rajender Goyal.
