Ours is PSU. We have issued one notification during 2013 for 8 posts. The process of selection delayed for 4 posts due to various reasons. Now during feb.2014 there is a ammendment to the method of selection. Since the selection process is not commenced for 4 posts can we cancell the notification issued during 2013 in respect of 4 posts and call fresh notification as per amended rules of recruitment. The amendment is with prospective effect i.e w.e.f Feb 2014

First of all, your description of the problem is quite inadequate to arrive at some definite opinion to solve your problem.
Secondly, suppose you cancel the notification, you will be inviting a plethora of problems for the management for a long time, as you seem to have already implemented the notification partially. Cancellation means abrogation of the notification along with the already made selection in totality, while you have already recruited candidates for 4 out of the total 8 posts.
The question arises, how you would be able to regularise the selection against 4 posts when you cancel the notification, i.e., by making that non-existent? Would not the panel of candidates drag the company in the court of law when you retain 4 selected candidates even after cancellation of the notification?
So, yours is not a problem to be discussed casually to get appropriate solution. Better hire services of some expert after providing him complete post-notification history of the case, along with the copy of the notification, for his examination and get a suitable solution to the problem.

you cannot apply new law on a pre-existing vacancy for which selection procedure is started.
Someone in the hierarchy is trying to grind his axe by cancellation of selection.

Sir,
thank you for your reply and advise. Here I want to clarify that 8 posts means not 8 vacancies but 8 types of posts viz.clerk,driver etc. However as per your advise services of legal expert is being hired.
