deposit all the cheques in bank . on cheques being dishonoured issue legal notice under section 138 Ni . if your friend fails to pay file complaint under section 138 NI . also file summary suit . if your friend is financially sound you will get back your money

Agree with the advise of expert ajay sethi ji.

Send notice for dishonor with in the prescribed period and file case afterwards.

Engage a good lawyer.

It seems that the cheques are of different dates i.e. for each month, it would be better to file separate case for each cheque bounce monthly.

If your friend (?) denies then you have to approach the court appoint an advocate. Court will give compensation and punishment / impresonment to accused.

contact local lawyer . issue legal notice at his permanent address . wait for his response . if dosent reply or does not pay you have not option but to file complaint under section 138 Ni / summary suit

if he do not have assets by his name so is their any possibility the amount can be recover by his family.Because purposely he is not doing job as he is aware off that i am going to go for a court proceedings

You can find out his current address also from his phone number also. The telecom operator and concerned police personnel in o/o Police Commissioner can provide the address as registered with Telecom Operator.
Apply your resources.

Arrange to issue legal notice within stipulated time after cheque bounce.

today second cheque also got bounced the reason bank gave is that account closed.Now i will be sending a legal notice to him bot i came to know from a common friend that now the borrower has started saying that we dont have any legal agreement that i have too return the money ............is this will effect the recovery

What is the proof that it was given?
was it given in one go or in many installments?
Can you account for its' source if he pleads

You have very good chance to recover your money.
First fle 138 ni, following due procedure of chq deposit/ rtd memo/ issue notice, lodge 138 ni complain, issue summon etc...
First two chq
alternate chq, lodge police complaint u/s 420 ipc, managing police station, and get him arrested[ next 2 chq
File civil suit for recovery [ last 3 chq]
Engage Adv of repute from Noida/ delhi.

i contacted a local lawyer today ,he said to deposit all the cheque in different date but deposit all of them because then we were able to file a single case for all 10 cheque .Further he said that it is better to file a case in delhi instead off Uttar Pradesh as the proceedings in Delhi are quick.Please suggest can i go for this

Deposit cheques one by one. Multiple dishonour incidents can be termed as more serious offence.

actually every cheque amount is 25000 so lawyers is saying if will issue a notice for two cheque then the amount will be 0nly 50000 then rest cheque cannot be claimed in this case please suggest
