Terms of Agreement to employ a person are generally different from the trust derived during the employment any person is liable for criminal breach of trust when he does any thing criminal in nature against the employer or any one who takes trust on him not to do so. It may be against some property or money. Even if a person mis-utilizes, misappropriates other's money other than the purpose for which it was given to him he is charged by the criminal breach of trust.

Yours is an academic query without mention of a real problem, if you are facing any. Every thing depends upon the terms of employment agreement.
