Legal notice on cheque bounce

Dear Experts,

I have a cheque which was bounced before 5 months. now it is settled law that we have to serve notice with in one month but no notice was served. what can i do now??? is this possible to file a 138 complaint in this situation..

For get the cheque bouncing case. Now file only cheating case and civil suit for money.

Now you will not be able to file a complaint case u/s. 138 N.I. Act.

However, you can file a summary suit under Order 37 for recovery of the money which is quite effective and speedy.
