(Querist) 14 August 2015 This query is : Resolved 
My father and his colleague(xyz) had purchased a plot in kanpur in the year 1975.The property was registered in the name of my fathers colleague(xyz) and my mother.Later after retirment my fathers colleague(xyz)left Kanpur on his on will and went to reside somewhere else. Before going he gave all the rights of the property to my mother in the form of power of attoney(MUKTHARAAM).In 1980 my father constructed a house on the said plot and we have been residing there for the last 35 years,all the bills we get i.e water tax,sewer tax, electricity bills etc are in the name of my mother.In 1999 my mother and subsequently in 2003 my father died.There is no will written or executed by mother.
We do not have any contact with my fathers collegue after he left kanpur neither his where abouts are known to us.we are 6 brothers and sisters all married.It is a leased property which has to be made free hold at the same times we want the property to be transfered in our name (all brothers and sisters). Can any body please suggest how to resolve the issue.

Check if he is drawing pension and find out his whereabouts Or inquire with other colleagues and return the share to him/legal heirs.



If he has dies the POA has also died with him.

Search the joint owner and get the property transferred. Power of attorney can not be used if any of the principal or Agent has expired.
