Regarding ex-post facto approval for higher education.

Querist : Anonymous (Querist) 29 December 2016 This query is : Resolved
Sir, my wife is in a central govt service (autonomous body). At the time of ccl she has done D.Ed course (regular but gone for examination only, attendance has been done by the college. Universities outside delhi provides education like this.). She did not taken approval at that time. She also cleared the Ctet which is mandatory now a days. Now, she applied for the post of teacher in central govt and the exam is going within few days. She has NPS account through this employer also she has CGHS facilities. If she will be appointed then what will happen and she also thinking about taking ex- post facto approval from the present employer so that in future she will be safe.

Will they accept her qualification and did not punish her. And if they punish her then she is able to apply for the post of teacher in future or not?

Neither she should expect ex-post facto approval, nor she can escape from disciplinary action by her employer under the CCS (conduct) rules for joining a regular educational course without specific permission of the competent authority.

Thanks P.S.Dhingra ji, if she resigns from her service and join new job and there is a certain gap between these two jobs then what will be the scenario?

No effect, if she resigns from the post and joins a new post, as a fresh candidate.

Thanks sir for ur opinion but as u r also aware that through this employer she has NPS account which is made through govt job and made only one time in a life and continues for whole life and if she resign and then joins a new job. The new employer will ask her how u have ur NPS account then what she will do. Because she filled the application form of teacher within this service and in the column where they ask whether you are employed she has written 'NO'. And if she resigns after the confirmation that she is selected than the gap between these two jobs is less. What will she do. Should she resign before giving examination or she will wait? And our biggest concern is about NPS account? Please solve our problem so that in future she will not fall in any trouble... Please give us suitable solution for this issue. Thanks

Mr. Anonymous,

Your supplementary question gives an impression, as if it is not a real problem, rather merely an academic question for which you wand answer. If she is the member of NPS, she must know the rules of NPS also.

However, for your information, as per the provisions of NPS an employee who leaves the employment he/she may continue to contribute at his/her own and when enters reemployment his employer may also contribute in that account.
