succession

(Querist) 27 January 2010 This query is : Resolved
what happens when a person makes a will with respect to a property but before his death he alienates with the property or a part thereof???

does that amount to revocation by subsequent conduct???
Arvind Singh Chauhan (Expert) 27 January 2010
Will shall be valid for the rest part of property after alienation, if there is no adverse clause in will.
Raj Kumar Makkad (Expert) 27 January 2010
I cannot be agree with Arvind on this matter. If the person before his death alienates any part of his property then his will already executed becomes invalid and revoked and thus law of inheritance prevails.
niranjan (Expert) 27 January 2010
Person who makes the will has full right to dispose off his property during his life time which results in revoking the will.
N RAMESH. (Expert) 27 January 2010
I fully agree with Mr.Rajkumar
B K Raghavendra Rao (Expert) 28 January 2010

By subsequent act or conduct the testator has revoked his will.
