Hello, I want an expert advise on the below matter.
We are a Muslim Family. My Father in law has been died with no Will. Now Brother-in-law and Mother-in-Law are telling my husband and me to leave the house. And for that my Mothe-in-Law is giving us the mental pressure. What should we do now? Please help us to resolve this issue. We will be greatful if theres anything in Muslim Law to get partition or something like that to spend a peaceful life. Waiting for the advises from all the experts.....

Your husband as a legal heir has equal right with all other legal heirs over the properties of your father-in-law.

Your husband is a valid successor and cannot be dispossessed. He can seek partition.

You can claim for partition with the help of a legal counsel if mediation for partition doesn't work out with family elders.
Rajendra K Goyal (Expert) 03 May 2017
File partition suit against all the legal heirs.

The share of all legal heirs is as per personal law that applies to your sect/sub-sect. e.g; Sunni,Shia………………..

Son should have a share.

Local counsels specializing in revenue/property/civil matters and well versed with personal law that applies in your case can advise you the best.

Even scholars of your community can guide you.
