railway refund for excess fare

Dear Sir,
One of my friend travelled by Howrah Express on 15 th feb 2010from vadodara to Jharsuguda with two other family mambers. He booked online e- ticket with irctc. During traveling he didn't have valid i card as prescibed by IRCTC. Although he had a photo i card provided by His bank SBI. He also had a xerox copy of Driving licence. TC fined him Rs. 5130/- gave him a excess fare ticket receipt. In the receipt Tc wrote two different figgers Rs. 3740+Rs. 1390. TC informed him that Rs.3740 will be refunded to him after some time. He will have to apply for the refund. My friend applied but till date he hasn't got his refund.Please guide me how can he get it back?

He can send a legal notice first. If the refund is still not done by the railways, then your friend can approach the Railways Claims Tribunal and file a case for refund of excess fare and also for compensation for delay in refund.

Please resort to litigation process immediately as it is a valid case to prove the harassment by the Railways. It would also open the floodgates to many.

Your friend can also file a consumer complaint against railways without serving any prior notice as he is a consumer and deficiency in service is proved in the given facts.

Dear Sirs,
Thanks for all of you for giving me quick reply. After posting this question here i visited IRCTC site. There I found some rules regarding this problem as stated here 1. The TDR Refund will be processed as per Extant Railway Rules:
2. TDR should be filed within 30 days of Departure of Train
3. The refund process will take at-least 90 days and more 5. In case Travelling without proper ID proof-will be considered without ticket and will be
charged accordingly. Chief Commercial Manager/Refunds can be approached for discretionary refund. Excess fare ticket (EFT) (in original) issued by the TTE is must to
claim for refund.PLease guide me according these rules.
