pensioner's joint account with spouse-2

(Querist) 21 September 2010 This query is : Resolved
even if the pensioner is a defaulter of a bank loan, balance in the pension account will be having contributions of amounts belonging to both the joint account holders, in such a case can the account be blocked if any one of them is a defaulter ?
Chanchal Nag Chowdhury (Expert) 22 September 2010
Pension amts. can neither be blocked nor attached. However, the moment the Pension comes into an a/c,the same may be treated like money from any other source.
Vinod Singh Tomar (Expert) 22 September 2010
Pension comes into pension account and branch manager of the bank is called and / or known as pension disbursing officer. Please go through the transfer of property act and civil procedure code, wherein it is clearly provided that pension can neither be attached nor transferred in accordance with the pension rules and regulations. Thus the question of attachment does not arise.
