payment of earned leaves

i m wrkng as mgr maintenance with pvt ltd chemical plant i m getting 10000+ salary and employer gives almost double salary as bonus on diwali but he refused encashment of earned leaves to one of my colleuages with more than 125 earned leaves inbalance on regisnation which is huge loss to us after servicing 5/7 yrs.Also no appointment letter has been given to us but pf from salry is deducted regularly. pl suggest what to do to get e/leave encashed with bonus.

Depends upon the provisions of leave rules of the company. In fact most of the companies allow encashment of leave only during service period not on resignation. You may therefore need to check the leave rules of the company.

About letter of appointment, you have not stated whether any offer of appointment with due mention of salary structure and other conditions of appointment was issued or not to you before appointment, and whether you signed in lieu of acceptance any such offer?

Thankx for your most valuable advise. i wld like to tell that nothing has been issued showing offer for appntmnt with salary nor any conditions for appntmnt has been declared.but i have letters showing my appntmnt with salary which company issued me when asked for opening a/c with bank or proof submitted to bank for getting car loan etc, i m getting form-16 for tds from company.my pf has been cut and deposited regularly. what else we reqr for showing an employee of company. pl advise further.
