sir ,
my grand father have plot of land that is 4 bigha .he has two son . he wanted to give this land in the name of my father.my uncle do not wanted the share of property in uttar pradeshor this 4 bigha land .
what should be the procedure :
1. can he transfer property in the name of my father .
2.should we have to get written NOC FROM MY UNCLE FAMILY ( MY UNCLE DIED LAST YEAR).
3. CAN MY GRAND FATHER DO ALL THIS THINGS FROM KOLKATA .
4.AS PROPERTY DOCUMENT WE HAVE KISHAN BAHI BOOK WHICH IS GIVEN BY LOCAL AUTHORITY ( UTTAR PRADESH GOVT.)

1)Yes if his name is recorded in kisanbahi/jotbahi and latest khatauni as sole owner.
2)if this land was sir or khudkast in the zamindari period then yes as a matter of law,otherwise desirable to avoid future disputes with them.
3)NO,he will have to visit sub registrar office.Many may say yes and suggest POA but same way i do not agree as even POA would be required to be registered here.
THE BEST COURSE WOULD BE THAT YOUR GF VISITS PERSONALLY AND GIFTS IT BY A BILATERAL DEED OF ACCEPTANCE OF GIFT AND POSSESSION AND OTHERS HEIRS OF YOUR UNCLE SUCH AS HIS WIDOW SONS AND DAUGHTERS (OR THEIER ISSUES IF ANY ONE PREDECEASED)SIGNED THE SAME DEED AS NO OBJECTION.
