Completion certificate

(Querist) 22 March 2014 This query is : Resolved 
Sir, we 23 flat owners have purchased flats in a single wing in d year 2009, it was agreed in our agreement that possession and completion certificate will b given at d last till end of dec 2013, however, that builder has given us oral possession in 2012 on d oral committment that water connection and electricty meter ill b given 2 u till may 2013. Subject to that we had taken possession. Now sir almost 1year has lapsed we r been provided borewell water and temporary electricty without our own meter. Except this 2 factor rest of building work is totally completed. N on last week we come 2 know that our builder has ran away from his office and residence. Now sir even I ill approach in consumer court and order is passed in our favour, how would we get CC from corporation and electric meter as as all d requisite papers for obtaining CC AND METER is with builder only, n without complying documentary works how can we get CC AND METER IN OUR favour. Advice me how would we resolved our grievances in this situation. D builder is not traceble

in such an extra ordinary situation,the municipality or concerned govt.depts may be approached with consumer court order and still strong if you all have formed a regd. resident welfare society of flat owners,
i view that your case will get the attention it deserves, and regular cc and meter connections will be granted.
since builder has absconded,some indemnities and affidavits will be obtained from your resident welfare society of flat owners and need ful can be done.it is not insurmountable.

Agree and on refusal writ may be filed directing them to issue CC etc.

Agree with the expert. Resident welfare Society should try to get water and electricity connection and on refusal from concerned departments, orders from Court can be obtained.

Refusal for basic amenities namely water and electricity is violation of constitutional rights. The ideas suggested by the experts may be followed for relief and remedy
