IPC 409

Querist : Anonymous (Querist) 05 March 2010 This query is : Resolved 
one of my relative is charded in 409IPC and f Bail application has been rejected from ADJ Court, is there any way to do compromise with opposite part(i.e state Govt) and get out from this case.
Disputed amount is around 12L.
Is there any legal process of compromise?

No there is no provision of compromise only of there is sufficient proof of being innocent there may be acquittal.

section 409 IPC is non-compoundable offence. So compromise is not possible in court.

if we approach to that department and ready to pay the disputed amount in that condition can department help us in this case?

As suggested by Mr. Ajitabh Acharya, an offence under section 409 of the Indian Penal Code, 1860 is not compoundable. So, the opposite party cannot compound the offence even if the entire disputed amount is paid. However, you may approach the concerned officers of the department who may help in the matter of punishments with regard to employment under the service rules.
