SERAFESI ACT

Respected Sir ,
our bank has got cleared one cheque amounting to Rs. 1279100.00 by fully overdrafting our cc limit & now issue us notice under scstion 13(2)of SERAFESI ACT.we have replied to this notice.now tell us the opinion what we have to do as the notice time given to bank is over & bank hasn't replied us to the same.

The bank cannot proceed further without considering/disposing your reply, which is mandated under Section 13 (3 A) of SARFAESI Act. If the bank proceeds to take possession of the property without considering your reply, then you can very well approach the DRT under Section 17 of the Act challenging such action.

Respected Sir ,
In our notice replied we have mentioned that we will file civil suit against the bank as well as personnel involved.Kindly provide us the contact details of experts in chandigarh who are dealing with DRT.
Also suggest can we complaint to bank obdassman.
