grandson's right to property of grandfather

(Querist) 28 November 2010 This query is : Resolved 
what are the rights of a grandson relating to the rented property (shop in possession for 50 yrs.) acquired by my grandfather (not alive)and is currently in posession of my father and uncle in partnership. Rent receipt still comes in the name of my grandfather.No will has been left by my grandfather nor by my grandmother(not alive).I belong to a hindu family. please help me.

The mere long user of the property in tenancy does not make any difference and even after so many years the relationship of tenant and landlord continues and the same does nor become the ownership property. If the landlord requires that property he could file a suit for eviction anytime.

in a rented property no person has a right except tenancy right. Mere having a status of legal heir of tenant neither your father or your uncle and you do not have any right. The owner has full right over the property and it can be vacated on showing sufficient reasons under the rent act applicable in the State.

You have right if your grand father died intestate.

However, you need to file suit for partition and for mesne profits if you want to get effect of right

Looks that you have not carefully gone through the query or the subsequent answers given by other experts.
The grand father did not own the property, but it was only tenancy rights.
I dobut anyone can file a partition suit for the same as advised by you.
