whether a Refugee has bee granted a land, but he abandoned the land. subsequently, his legal heirs got the land as per record, but without posession.
Now, legal heir files writ petition sayign he is entittled to land on the basis of record, secondly, as a refuge, he is entittled to a land irrespective of his parents land. another thing, whethe ina wirt petiton, isues are framed or not, and during premilinary hearing of writ petition, can court take evidence or order for an investigation committee

The decision of the Delhi HC dated 30.11.2010 has been rendered in the peculiar facts and circumstances of the case of displaced J&K Pandits who were working with the Central Govt., who were allotted government accommodation, but later on asked to vacate when such persons retired from service. It is a landmark decision from the HC by a pragmatic Judge.
