My deserted me since 4th Jan 2011 as she do not want to take responsibility of our home and my unhealthy parents who has blood cancer. i tried a lot to get her back home but her father refuse to send her and says they need 6 to 8 months to think. At last i have no option to file RCR. Now my questions are :
1) If court pass decree to me what should i do to execute RCR?
2) If my wife still refuse to cohabit what should i have to do?

sir, the court only order to RCR, otherwise nothing do to so. you can file again one memo aforesaid reason.

Even if you get decree in your favour, you can not compel your wife to stay at your home. If wife refuses even after decree in your favour, you will be entitled to get divorce. Thats all! Find someone else to take care of your parents.

Even you got the decree in your favor in spite of that if your wife does not want to join you then you shall have the option to file divorce. It is batter to wait and watch for the period of your in laws.

For non compliance of decree you can either o for divorce after one year or for implementation of the decree by attachment of her properties.

Thanks for reply. If she not cohabit with me and if i go for divorce after 1year of rcr decree.

1) will she ask me for maintenance?
2) how i negotiate with it? our marriage prolongs for just 7.5 months from 13.05.10 to 04.01.11.

No sooner a person gets married, he becomes liable to maintain his wife. Your wife may ask for maintenance, if she is unable to maintain herself.

I filed RCR but she have not accept the court notice and not appeared in court even she would not bother to submit her reply in court.

Now what should I do?
