A gentleman served in HPCC & after retirement withdrew some amount of CFP contribution.Later, he made many representations etc & served a legal notice but his parent department replied that his account has been made by CPF & subsequently CMPF Authorities.He filed a complaint before District Forum but OP has raised the point that DF is not competent.Plz advise.If some favourable judgment to this aggrieved is known,plz make it known.

Regional Provident Fund Commissioner v. Shiv Kumar Joshi, III (1999) CPJ 36 (SC)).
Further clarifying the scheme of the Consumer Protection Act, 1986, which they held to be helpful, in interpreting the meaning of words falling under it, the Supreme Court, in Laxmi Engineering Works v. P.S.G. Industrial Institute, (JT 1995 (3) S.C. 433 : II (1995) CPJ 1 (S.C.) has declared that the entire Act "revolves around the consumer and is designed to protect his interest. The Act provides for "consumer-to-business" disputes and not for "business-to-business" disputes.
As per the definition set out in Section 2 (1) (b), Consumer Protection Act, 1986, a person can be a 'complainant' only within the definition of a 'consumer' contained in Section 2 (1) (d) of the said Act, and not when such person falls outside the purview of the expression 'consumer.' However where a general insurance policy insurer pays the claim, than such insurance company stands subrogated to the rights and remedies of the claimant in respect of loss or damage to the goods. Such insurer alongwith the insured can maintain a complaint as has been held by the National Commission in Roadwings International v. Hindustan Copper Limited and another. (III (1999) CPJ 23 (NC)).

Sh.Makksd ji,
I am grateful for appropriate legal guidance with suitable law on the subject.But in my case, the complainant has not arrayed CPF/CMPF Authorities.Then how the PARENT DEPARTMENT is liable ?

Some moments for FUN.....
Mr."X",an advocate frantically tried to become a Judge of the High Court."Y" a close friend of "X" inquired from him, " Dear Y,tell me one thing yaar,your knowledge of law is only so so, then how would you write judgments ?'
He replied:"I will befriend with CJ,alwayus sit in DB.The other Judge will write Judgment & I will sign against the line noted by steno, " I AGREE" !

Oh Sir,
"Fun is Fun".It never has any relelvance or reference to anybody.I only wished to break the monotony.I am sure this kind of "fun" or 'cutting jokes' or narrating jovial incidents are sure to rejuvenate all the experts here.
I am truly bewildered by by 'curiousness'.I got the idea by reading the famous book "The Monk who sold his Ferrari".I suggest all that 'its worth reading'. Moreover I am given to understand such JOKES etc are not prohibited in this Forum.
Heres another one:
A litigant was asked by advocate to pay Rs.10,000/- as his fee.
Litigant:Last time there were some advocates who charged only 500/- or so.
Adv:Those who charged this much fee have become Judges......!???
Eh,D'u like or not ?????
