Offence for withdrawing consent?

(Querist) 25 January 2012 This query is : Resolved
On going divorce case is converted into MCD case and subsequently I withdraw my consent and deny for divorce as I don't want divorce to be done. I can withdraw my consent at any time before court decree.

My query is subsequent withdrawal of consent in this case attract any offence under any acts prevailing in India?

What consequences I have to suffer?

What consequences my family members have to suffer?

Is situation is differ if such acts done by husband instead of me?

noyou are free to withdraw your consent at any time prior to divorce being granted .

case will be contested . may take years for divorce to materialise .

family members dont suffer any consequences

no difference if acts done by husband

No offence at all!

Except that the case would become contested neither you nor your family would be under any sufferance arising as consequence of withdrawal of consent. It applies equally to either of spouses.

Sheetal,
No Offence,for any party.

Divorce Petition will continue &be decided on merit, and this FACT of incidence of consent and your refusal later on will also have it's impact on Judgement.

The other party can still go for contested divorce and revive his petition.
