Certified will vs original will

Guest (Querist) 24 June 2012 This query is : Resolved
SIR MY FATHER PASSED AWAY IN YEAR 2004 HE MADE HIS WILL IN THE YEAR 2000. I HAD LOSTED THE WILL , BUT AS I KNOW THE VOLUME NUMBER SO I OBTAIN CERTIFIED WILL FROM THE REGISTRAR OFFICE. MY SISTER HAS CHALLENGED THE WILL . DOES THE CERTIFIED WILL HOLDS ANY VALUE . AS MY FATHER MENTIONED THAT SHE HAS NO SHARE IN THE SAID PROPERTY. AS HE GAVE HIM ALL THE VALUABLES IN HER MARRIAGE AND GIVING ITSELF.

Last will is the one which can be acted upon.

Whether the same is registered or not is immaterial.

The last Will always prevails.
However this must be validly executed to prevail upon previous testaments.

File FIR regarding the original lost will in police station of ur area of ur state and then the certified copy of said will have
legal validity. Also give a PUBLIC NOTICE of lost will in at least 2 leading newspapers
of ur state.

If the registered will was the last one, you can succeed in the challenge made by your sister.
