Interimorder

(Querist) 11 September 2012 This query is : Resolved
The family court judge has ordered a very low interim maintenance to be paid from 2010 last month.
I want to file a writ that will be dealt with in 2 weeks. Is such a petition called a writ appeal or a CMA under article 227 read with section 121.

the main point is i want the order impugned and another decreed by the HC in its place and in 2 weeks.

it is called civil appeal and u cannot force time limit on court.
Bhuvan (Querist) 11 September 2012
I read that the writ petitions are decided within 2 weeks and if it is not replied to within 2 weeks the order stands vacated as per some rule for writs. Does the same rule apply for writ appeal too.

Your reading is not correct. It is unheard.

Normally such nature of CMA’s are disposed off by giving 2 weeks time to respondent and by within a month.

High Court may return it to Family Court . It will be disposed off quickly, say a month,
