Sir,
We had bought a room in a pagdi system 30 years ago, from the then room owners without any sale deed or agreement. Now, we have owned a flat in a near by society since last three years. Our land lord is preparing to claim in a court possession of our room in pagdi system saying we are not staying in that room and we are not in need of it now but in future we will required. He has stopped taking rents from us since last 10 months and the light bill,water bills are been paid by us regularly. Can we defend this ? Please advise.

in whose name is the rent receipt? is the flat bought in same name?
go and strat staying in said pagdi room .send rent by demand draft with a covering letter .

rent receipt is on my grand fathers names.......and thanx.......if we dont stay there and just visit their once or twice in a week to show that we r using it,then also landlord make case that u r not living here,then what to do???

on your grand father death his children who were staying with him would be deemed tenants . you ought to have tried for transfer of tenancy in name of legal heir.

OCCUPATION IS MUST TO CLAIM TENANCY RIGHTS.
SEND MONEY ORDER OF RENT INTIMATING HIS DENIAL TO ACCEPT KEEP A PHOTO STATE OF THE ENTIRE FORM WITH MO RECEIPT.IF DOES NOT ACCEPT THEN DEPOSIT IN COURT HAVING JURISDICTION.
