My Father render his service in a Lodge @ 1500 Rupee per month as a care taker for last 17 Years where he suppose to work more than 12 hours in a day, no holiday no leave concept was there. remuneration is too low even remuneration does not meet with the mininmum wages act.
Now I am seeking an advice of getting compensation for the service rendered by him for 17 years under minimum wages act so what i need to do now and what amount we can get as a compensatation for the same.

He must be Casual labour. Salute to him, he managed house with 1500 p m and he made you, his son Sr. Exe.
Lodges & Hotels covered under Industries, provided the permanent no of employee as per Act. Then only u succeed, otherwise not.

In the Hotel no one have employee number it a lodge hardly 5 people working there.this hotel belong to my maternal grandfather . now what needs to be done.

Where is any sense now to go to Labour Commissioner or Inspector for your area.

Hotel is belong to my Maternal Granfather, After his death this is divided in 5 part 4 maternal uncle and 1 part to maternal Grand Mother, My father was working somewhere so my maternal grandfather asked my father to work with us ,my all sons are working on their own business. so you take care of the hotel , Hotel is actually a lodge which has very low earning. Now Maternal Grandfather and Grand mother both died , Now the property of my Maternal Grandfather and Grand mother suppose to divide in all 7 children but by maternal uncle are not getting agree on this point so i raise this query as a backup in case we are not getting the share in the property then whether we can lodge a complaint for labour exploitation and can get a compensation if yes then how much . please help. I hope you understand my issue.

This gives no explanation as to how your father worked merely as a caretaker in his own ancestral property.

Pratik! there seems flaw in your query when one finds that your father is working as a caretaker in his own property at a meagre wages of Rs. 1500/- since last more than 17 years/ From whom he shall claim such compensation and why did he sit for a long time till day?
