Rent deal gone sore

I have reached to property dealer in Dwarka to rent a 2BHK DDA flat, after some times he offered me flat in sector 9, we liked the flat and stuck the deal by paying 2 months security by cheque Rs.29000, advance rent and broker ship Rs.14500 & 12000 respectively in cash. While it was agreed to that before we shift (2nd June 13) landlord will do the whitewash and installed iron window in drawing room. But when we have gone to installed ac on 1st June 13, to our surprise the house was still having the furniture and goods of previous tenet, while we have already booked movers & packers to shift our stuffs on 2nd June 13. Also we have found that water in one of the bathroom is nonfunctional. The dealer was taking things very lightly and making silly excuses. We had arguments on various things and one leads to another. Meanwhile we have also found that this flat is belonging to one of many partners of same property dealer. And those all stuffs were belong to him, as he was occupying the same house and he recently moved to other society. While we talked with him on phone as he was claiming out of town, he instructs us to get our refund as he cannot take such pains. After cancelling the movers & packers and taking my fitting back I went to their shop and got the refund except Rs.10000 which he told me to collect on next day 2nd June 13. Later when I gone to collect my balance he was saying that they have invested on iron window and whitewash, contrary it was me who had got his money loss, uncertainty and mental disturbance, later one of their partner had given in writing on the back of their business card that they will return my Rs. 10000 on or before 31st July 2103.
Now they are refusing to return my money by giving same old silly excuses and even saying I can do whatever i want to.
Do I have any hopes of getting my hard earned money back from them? What are the ways and options are available to me. I need your support and help on this.

Write a letter to them narrating all facts and send it to them through registered post preferable to the landlord also making him equally liable and clearly highlighting that you would file an FIR and take all civil and criminal action against them if the money is not returned within a week and hope for the best.

I would humbly request on providing your valuable suggestion, whether I need to send registered letter through lawyer or I should do it myself. As I am not an expert in laws, I fear of missing important points and may lose the ground. There is also second thought given by someone to take consumer court way. I need your guidance.

Send Notice thru Advocate.
Wait for Reply for further action.
[ consumer forum or civil suit/ or criminal act of cheating.]

Send notice to brokers also for deficiency in service after collecting good brokerage, though rtd, you had mental agony, suffered, lost etc..
