Regarding uncleared cheque

I paid payment via chq to Reliance BB, due signature mismatch bank stopped the payment and sent the chq to Reliance. Reliance disconnect my BB service, i paid payment by cash and request Reliance to return my uncleared chq, as bank wrongly stopped the payment and now agreed to refund penalties deducted from my SB account but on production of uncleared chq. i.e. with Reliance.
Now, Reliance is not giving my uncleared chq back, despite i have paid same bill payment in cash and next bill payment with Rs.100/- penalties.
Kindly advise what legal action can be taken against Reliance a Police Complaint first or directly legal notice or consumer court.

cheque has only 3 months validity . keep proof of having made full payment . address letter to the company not to present cheque again as full payments made .no need to move consumer court or filing police complaint

Ask the bank to stop payment on the basis of the said cheque.
Consumer complaint shall not lie against mobile service provider.
You can lodge complaint with TRAI.

When you have made the payment, no need to get the cheque. You may write letter to Reliance on the above advised lines. Worst, if the cheque is again paid to Reliance, same would be credited in your account with them.
If you want to proceed against the Bank for wrongful dishonor of the cheque, you can ask reliance by lodging a written request to return the cheque .
