Want to file for divorce living seperate for more than a year

(Querist) 30 November 2013 This query is : Resolved 
Our was a love marriage with the consent of our parents 4 years back. I am a Christian and he is Hindu. We couldn’t stay together due to so many differences in opinion and our unresolved problems became life long issues. Now I am staying alone for more than a year in same city and even though we tried to patch up differences kept coming in between us especially related to his mother and other issues. Now we have decided to go for divorce. Need your help to know the procedure problem is-
•We didn’t got registered marriage
•We married in church where he converted in Christian and we also married as per hindu religion.
In such a scenario what is the procedure? Do we need to file a divorce case in my native – where church marriage took place or can file in the place of residence of my husband. Please help me.

You can file case where you are currently residing under Indian Divorce Act.

When you can patch up the differences with him why can't you do that with his mother? Yours is a love marriage. Have you thought of future after the divorce? Since it is love marriage, both of you sit together and again try for reconciliation. The differences with parents-in-law are temporary.

since both of you have decided to go in for divorce contact a local lawyer . if your husband had converted to christanity for marrying you then file for divorce under indian divorce act

If your marriage was solemnized in a church,and that you both have decided to legally part with each other, you both can jointly file a petition for divorce on mutual consent under the provision of Indian Divorce Act.
