Rent agreement

Dear Experts,

1. We are entering a rent agreement for 3 years and further one clause we want insert for further renewal of the same for next 2 years.Is this agreement valid in law OR bad in Law.

2. Can we execute a rent agreement more then 11 months with out registering the same in court of Law. Is this agreement enforceable in Law ?

3. Which documents can be Notarized through a Notary to make the documents valid in Law ?

Sir,
In Maharashtra there are three modes for taking or giving properties on rent;
[1] Rent Agreement, [2] Leave & Licence agreement and [3] Lease agreement.

Each of these has to be stamped and registered.

The agreements you propose is a Leave & Licence agreement, you can include a renewal clause therein, it has to be registered after affixing stamps of the value of proper stamp duty.

None of the above documents are valid unless properly stamped and registered.

registration of rent agreement / leave and license agreement is mandatory under maharashtra rent control act . you can incorporate renewal clause in leave and license agreement

Notary attested rent agreement even for 11 months is not legal in many states. For more time it need to be Stamped and registered. Mentioned clause can be inserted in the said document.

We are from Delhi State , DO we need to go through Rent COntrol Act.

Delhi has a very stringent Rent Control Act in place,please tread carefully and take legal advice before entering into any rental agreement.

Rent agreement below the period of 11 months is not compulsorily registrable in delhi.
